Terms of Service of the Jester - Party games app

1. General Provisions

• The owner and publisher of the App is Progmar (hereinafter: "We", "Creator").
• The App is strictly for entertainment purposes (a party game).
• Age Restrictions: The App is intended for users who are at least 13 years old. The exact age rating for your region (e.g., PEGI, ESRB) is determined and verified by the rating system on the App's page in the Google Play store.
• We reserve the right to modify, suspend, or withdraw the App (or its individual features) at any time.

2. Rules of Use

• Downloading: The App is distributed exclusively via the official Google Play store (for the Android system).
• The User agrees to use the App in a lawful manner and in accordance with these Terms.
• Login and communication: The App uses anonymous login or optional login via the Google Play Games service. These mechanisms are used for User authentication, communication with our servers (backend), and to support features such as the achievement system and leaderboards.
• It is strictly prohibited to attempt to hack, modify, or disrupt the operation of the App's servers.

3. Technical Requirements

To use the App properly, the following conditions must be met:

• Possession of a mobile device (smartphone or tablet) running Android 10 (API level 29) or newer.
• An active Internet connection (to handle login, purchase verification, and ad display).

4. In-App Purchases

• The App offers optional, one-time purchases that unlock additional question packs or features. There are no auto-renewable subscriptions in the App.
• All transactions are processed and handled directly by the Google Play store. The Creator does not process payments and has no access to your billing information. A third-party tool (RevenueCat) is used solely to verify the purchase status based on anonymized identifiers.
• All refund requests are subject to the Google Play store policies and should be directed to the store operator. Purchased digital content is generally non-refundable from the moment it is delivered to the User, unless mandatory local law states otherwise.

5. User Feedback

• If you choose to send us suggestions, feedback, or report an error in the questions using the built-in form (this data is saved in our cloud database), you grant us a non-exclusive, royalty-free, and perpetual right to use, modify, and implement this feedback into the App, without any financial claims on your part.

6. Intellectual Property

• All rights to the App, including trademarks, source code, texts (questions, challenges), graphics, interface, and design, belong to the Creator.
• They are protected by the Polish Copyright Law (Act of February 4, 1994, on copyright and related rights, as amended) and by international intellectual property treaties (including the Berne Convention) across all fields of exploitation.
• Copying, modifying, reverse engineering, or distributing the App's content without our express written consent is strictly prohibited and may result in civil and criminal liability.
• The Creator grants the User a limited, non-exclusive, non-transferable, and revocable license to use the App solely for personal, non-commercial purposes consistent with its intended use.

7. Disclaimer of Liability

• The App is provided on an "as is" basis, without any warranties of proper operation on every device.
• Access to purchased digital content within the App is granted for an indefinite period, but only for the duration the App remains available on the market (see Section 8).
• Important – Party Game Clause: We assume absolutely no liability for any actions taken by Users during or as a result of using the App. We are not responsible for any material damages (e.g., phone damage), physical injuries (e.g., during challenges), moral, or relational damages (e.g., conflicts between players) resulting from playing Jester. Play responsibly, use common sense, and strictly respect the boundaries of other players!

8. Termination of Services and App Closure

• We reserve the right to modify, suspend, or permanently close the App, including shutting down the servers necessary for its operation, at any time.
• In the event of the permanent closure of the App, the User will lose access to the App itself and the content unlocked within it. We stipulate that we are not obliged to refund previously made purchases.
• However, we respect our players. Should a decision be made to permanently withdraw the App from the market, we will provide advance notice (via an in-game message). Users who have purchased premium question packs will have a period of 1 month (30 days) from the announcement date to contact us at [email protected] to receive a digital copy of the purchased questions (e.g., in PDF format). The prerequisite for sending such materials will be successful verification of the proof of purchase (e.g., the GPA transaction number from Google Play).

9. Changes to the Terms

• We reserve the right to change these Terms at any time. We will notify Users of significant changes via a message displayed in the App. The updated version will always be available in the App menu and on our website. Continued use of the App following changes constitutes acceptance of those changes.
